LAWRENCE, KS — June 10, 2014 —
BSA | The Software Alliance, the leading global advocate for the software industry, today announced a settlement with Lawrence-based Heritage Tractor in the amount of $145,000 to settle legal claims that it had unlicensed copies of Microsoft software installed on its computers. As part of the settlement agreement, the company agreed to delete all unlicensed software from its computers, acquire any licenses necessary to become compliant, and take measures to ensure its future compliance, one of the foundational principles of proper software asset management (SAM).
Heritage Tractor is an agricultural and consumer equipment dealership in the eastern Kansas and western Missouri areas, specializing in the sale of John Deere, Honda Power and Stihl equipment.
As the leading global advocate of the software industry, BSA is committed to raising awareness about the risks associated with software piracy and taking action against illegal software use across the globe. These settlements are the result of BSA’s enforcement program which investigates cases concerning alleged under-licensing, a form of copyright infringement that occurs when software is installed on multiple computers without proper authorization.
"Under-licensing is a significant contributor to the overall software piracy market and affects all industry sectors," said Jodie Kelley, BSA's Senior Vice President and General Counsel. “The use of pirated software significantly affects fair competition, ultimately generating an environment that stifles innovation and the creation of new jobs through technological advancement. All businesses need to be certain they have adequate licenses for all software installed on their computers since the risks associated with using unlicensed business software can ultimately result in compromised efficiency, exposure of sensitive company information, and paying legal damages,” continued Kelley.
Through its programs, BSA works to protect its members’ rights, promote fair competition through lawful software use and offer anti-piracy solutions to help organizations reduce legal and security risks while driving business value. BSA’s SAM Advantage is a state-of-the-art training course and certification program for IT managers that teaches the necessary skills for effective software management. BSA also offers Verafirm Certified*, a product that independently verifies whether an organization’s SAM processes align with the ISO SAM standard and are ultimately license compliant.
Through its online reporting form www.nopiracy.org and its anti-piracy hotline, 1-888-NO-PIRACY, BSA receives voluntary tips and investigates hundreds of software copyright infringement cases per year in the United States alone. All reports are kept confidential.
*Verafirm Certified was formerly known as Certification in Standards-based SAM for Organizations (CSS(O)).
