BSA Statement on the EU’s Proposed AI Liability Directive

BRUSSELS – September 28, 2022 – BSA | The Software Alliance offered the following statement on the AI Liability Directive proposal, released today by the European Commission:

“More and more European businesses and organizations are leveraging B2B technology, including AI, to digitally transform and grow. BSA welcomes the effort to further harmonize AI rules across Europe – particularly the Commission’s objective to align the AI liability proposal with the AI Act. To this end, we encourage the co-legislators to adopt a risk-based approach to AI liability in keeping with the goals and structure of the AI Act,” said Matteo Quattrocchi, Director, Policy – EMEA at BSA.

“The newly introduced AI Liability Directive will rely on compliance obligations set out in the AI Act. As both proposals make their way through the legislative process, EU policymakers should clarify the allocation of responsibility along the AI value chain to make sure that responsibilities for compliance and liability are assigned to the entities best placed to mitigate harms and risks,” Quattrocchi added.

“The goals of AI governance should be to promote innovation and enhance public trust. Earning trust will depend on ensuring that existing legal protections continue to apply to the use of artificial intelligence. BSA and our member companies remain committed to working with policymakers, the businesses community, and civil society to help shape thoughtful, responsible policies to unlock the benefits of AI in Europe,” said Quattrocchi.
