BSA Submits Comments on the Personal Data Protection Bill, 2018

New Delhi, October 01, 2018 — BSA | The Software Alliance supports the Government of India’s effort to develop a framework that both protects the privacy of Indian citizens and spurs innovation and economic growth. Our comments submitted to the Ministry of Electronics and Information Technology (MeitY) on the Personal Data Protection Bill highlight important steps to achieve these dual objectives. We urge MeitY to revise the legislation to ensure that it provides strong protections for individuals while also allowing sufficient flexibility for businesses to implement accountable safeguards; help realize the potential of innovative technologies by removing data localization requirements and cross-border data transfer restrictions; and enhance the effectiveness of the data protection authority — an important part of the proposed data protection framework — by streamlining its functions and ensuring that its remedies are proportionate to the risk of harm. We look forward to working with MeitY and other government officials as they further consider how best to protect the privacy of Indian citizens.
