Statement from BSA | The Software Alliance on Today's CJEU Decision on Safe Harbor

WASHINGTON — October 6, 2015 — "BSA | The Software Alliance is very disappointed by today’s decision from the Court of Justice of the European Union on the Safe Harbor agreement.

We are still studying the details of the decision but are very concerned that this decision will have a negative impact not just on providers of data services but will also be harmful to consumers of those services.

Today's decision further underscores the importance of ongoing negotiations to craft a renewed and strengthened framework. Urgent action from both the US Government and the European Commission in this regard is needed to ensure European individuals and enterprises have full access, without undue disruptions, to the range of data services now transforming the European economy.

BSA members are committed to fully protecting their customers' personal data, and the Safe Harbor agreement is an extremely important instrument. We urge prompt conclusion of the revised Agreement and we will work tirelessly for clarity in European and US regimes, and urge immediate enactment of Judicial Redress Act now pending in Congress.”
