EU: BSA’s Input to the European Commission’s Targeted Consultation on the Draft Guidelines for the Classification of High-risk Artificial Intelligence Systems

BSA’s response to the European Commission’s consultation on the draft Guidelines for classifying high-risk AI systems under Article 6 of the AI Act calls for greater legal certainty and a risk-based interpretation of the AI Act’s high-risk framework. The submission urges clearer guidance on the classification of general-purpose AI systems, safety components, and Annex III use cases, while emphasizing that responsibilities should remain aligned with the AI Act’s allocation of obligations across the AI value chain. It also recommends more practical examples, clearer thresholds, and proportionate implementation to avoid over-classification and support innovation without compromising safety or fundamental rights.
