BSA Reaction to EU GPAI Code of Practice

Business Software Alliance Director of Policy for EMEA Hadrien Valembois issued the following statement after the release of the European Commission's Artificial Intelligence (AI) Act's Code of Practice for general purpose AI (GPAI) models:

"This final version of GPAI Code of Practice appears to make welcome improvements that make it more flexible and therefore workable for the development and adoption of trusted AI in Europe. BSA made several suggestions to improve the Code of Practice, and we are heartened that some of our concerns have been partially addressed. Specific improvements include better protections of trade secrets and proprietary information, the revised Code's additional flexibility in its compliance with the Act, a welcome reference to the EU Copyright Directive and its well-crafted and balanced text and data mining exception, and the Code’s better alignment with the scope of the AI Act. These changes improve the Code, though some provisions of the Code remain concerning to BSA. 

BSA wants the AI Act to bring clarity to Europe's regulation of AI and help fuel the adoption of trusted solutions across the continent. At each stage of the Code of Practice's development we have engaged to provide constructive feedback because BSA wants the process to lead to a good outcome. With less than a month until the Code becomes binding, the Commission should consider options to calibrate timing to allow companies to evaluate the Code and determine their commitment to comply with its provisions."
