India: BSA Submission to DPIIT Committee on Copyright and AI

In a letter to Department for Promotion of Industry and Internal Trade (DPIIT) Committee on Copyright and AI, BSA recommends that India introduce clear statutory text and data mining (TDM) exceptions to enable lawful AI training while protecting rights holders and providing legal certainty for AI development. BSA advises against over-reliance on licensing frameworks and supports ongoing multi-stakeholder efforts to develop effective, consensus-based technical mechanisms that allow for the expression of preferences on AI training data usage. BSA also encourages protection for artists against unauthorized AI-generated digital replicas and maintaining strong remedies for copyright infringement in AI-generated outputs.
