Korea: BSA Comments on Draft Notice to Implement Article 32 of AI Basic Act

BSA filed comments on the Ministry of Science and ICT's draft Notice implementing the AI safety obligations under Article 32 of Korea's AI Basic Act. BSA urged MSIT to defer finalising the Notice until the ongoing review of the AI Basic Act concludes, cautioning that binding rules issued now would pre-empt the AI Basic Act Improvement Working Group and require businesses to prepare for obligations that may soon be revised. BSA also recommended a more workable scope of application and incident reporting regime, including clearer definitions of key terms, attaching obligations to AI models based on each entity's role, defining reportable incidents by reference to specified serious harms, and extended reporting timelines aligned with international approaches.
