The signatories advocate policies to foster robust competition and encourage investment and innovation. We are disappointed in the outcome of today’s trial. The unauthorized copying for commercial purposes of substantial and essential elements of a competitor’s code in a manner that undermines the market for that software seems inconsistent with public interest goals of the fair use defense.
