Australia: BSA Submission on the Digital Seller Underperformance Policy

BSA urges the Digital Transformation Agency (DTA) to reconsider the proposed Digital Seller Underperformance Policy by first explaining its necessity and why existing procurement mechanisms are insufficient to address the Government’s concerns. If the policy is adopted, DTA should refine definitions and ensure alignment with existing procurement frameworks. BSA recommends the DTA introduce specific safeguards, including objective criteria for reporting, clear evidentiary standards, appeal mechanisms, independent review and oversight, and confidentiality protections, to prevent misuse and ensure fairness. BSA also calls for minimizing administrative burdens and avoiding duplicative oversight that could deter supplier participation and innovation.
