All five state consumer privacy laws create new rights for consumers, impose obligations on businesses that handle consumers’ personal data, and create new mechanisms to enforce those laws.
In 2022, 80 percent of state legislatures explored social media or platform regulation legislation. Additionally, there was a 70 percent increase in the volume of bills from 2021 to 2022 and the number of bill enactments climbed from 2 in 2021 to 13 in 2022. The vast majority of those new laws are related to third-party sellers on online marketplaces.
Digital transformation bills continued to influence state chambers across the country. More than three quarters of state legislatures considered some digital transformation legislation in 2022, ranging from remote online notarization to open data to cloud computing.
In 2022, 12 more states introduced procurement-related legislation than in 2021, which accounted for a 46 percent increase. Not only did more states introduce legislation, but the overall quantity of procurement-related legislation increased from 98 to 370.
Tremendous advances in AI are quickly transforming expectations about how the technology may reshape the world. However, the majority of state and local bills focused on a narrow subset of AI use cases involving law enforcement and facial recognition.
