BSA Supports Free Flow of Cross-Border Data in Comments to USTR on Supply Chain Resilience

In post-hearing comments, due this week, industry groups reiterated that the private sector is key to resilient supply chains and urged USTR not to erect new barriers, including related to data. The Consumer Technology Association, the Coalition of Services Industries and the Global Data Alliance, for instance, took the opportunity in their June comments to criticize USTR’s digital trade approach after the agency last October withdrew U.S. support from certain digital trade proposals in plurilateral World Trade Organization talks on e-commerce.
The U.S. should avoid “forced localization” and allow for free cross-border flow of data, CTA argued, a sentiment echoed by the other groups. “It is not too late to correct course. The United States can still counter adversaries’ efforts to replace cross-border data rules that advance US values, US law, and US interests with new rules that do the opposite,” GDA’s submission says.
