We write regarding a development of consequence to the US government’s strategy for revitalizing American industry and technological leadership. Together, our organizations represent the core of America’s advanced manufacturing and technology base, from automobiles, semiconductors, and precision machining, to industrial software, AI, and quantum, across large and small businesses alike. We write in relation to an emerging US Patent and Trademark Office (USPTO) practice before the Patent Trial and Appeal Board (PTAB) that is raising costs for American manufacturers and consumers, while undermining the US government’s efforts to promote industrial reshoring, strengthen domestic supply chains, and address affordability concerns (hereinafter “new PTAB practice”).
