BSA Highlights Concerns With Data Transactions EO Definitions

BSA | The Software Alliance Director, Policy and Executive Director, Global Data Alliance Joseph Whitlock discusses President Biden’s recent executive order on cross-border data transfers and urges the administration to ensure the order aligns with other global privacy frameworks.
“It is a very ambitious executive order … and covers a lot of sectors of the economy, different types of transactions, and so forth,” Joseph Whitlock, director of policy at BSA | The Software Alliance, said. “So it is essential that industry and the government work together to identify any potential unintended consequences, take them into account and address them.”
BSA is concerned that some of the definitions are too broad and don’t align with other privacy regulations and is urging the administration to ensure it’s aligned with global data privacy frameworks to ensure the rules are interoperable with frameworks like those in Europe. The industry group is also concerned the order includes encrypted data, anonymized data and de-identified data, arguing that language could force companies to de-encrypt data and potentially pose security risks to some consumer and government data.
