BSA Aims To Steer “Wave” of State AI Legislation Toward Risk-Based Approach

According to the BSA’s analysis, which notes “a wave of AI legislation is building,” states went from considering fewer than 200 bills related to artificial intelligence in 2023 to nearly 700 in 2024.
The group generally supports legislation that would obligate companies to conduct impact assessments based on the level of risk posed by a particular use of AI, rather than applying blanket transparency rules, for example.
“We expect state policymakers at all levels to carry this momentum into 2025 and introduce hundreds more legislative proposals related to AI,” BSA said in a summary of the analysis, noting they “will continue to urge lawmakers to focus on high-risk uses of AI and to drive toward a consistent and harmonized approach to legislation, rather than pursue divergent or conflicting models.”
