BSA and Global Data Alliance Call On Brazil to Release Data Transfer Guidance
SÃO PAULO – September 9, 2020 – BSA | The Software Alliance and the Global Data Alliance today sent a letter urging the Government of Brazil to issue guidance confirming that companies may continue to responsibly transfer data internationally based on global best practices.
“Responsible international data transfers based on flexible mechanisms are key to Brazil’s global competitiveness across all sectors of the economy,” said Antonio Eduardo Mendes Da Silva, Country Manager – Brazil at BSA | The Software Alliance. “As discussions regarding the recent invalidation of the Privacy Shield demonstrate, legal certainty regarding those mechanisms is extremely important to allow companies to continue providing innovative products and services to customers around the world. BSA and the Global Data Alliance encourage Brazil to issue guidance confirming that data transfers can continue based on best practice transfer mechanisms when Brazil’s Data Protection Law (LGPD) enters into force and until LGPD implementing regulations are in place. BSA and the Global Data Alliance appreciate the important privacy protections in the LGPD and look forward to continuing to work with the Government of Brazil as it works to implement the LGPD.”
