EU: BSA Position Paper on the Digital Networks Act

BSA’s position paper on the Digital Networks Act endorses the EU’s objective of strengthening connectivity and digital infrastructure while calling for a clear, proportionate framework that preserves innovation and existing market dynamics. The paper advocates for clearer definitions and safeguards to maintain the existing regulatory regime intact for the purpose of regulating core telecommunications services, which are the focus of the DNA, without extending the scope of the proposal to other technologies. BSA further recommends limiting regulatory obligations such as the general authorisation regime to traditional public electronic communications providers, avoiding overregulation of the broader digital ecosystem. The paper also rejects the introduction of a voluntary conciliation mechanism, which could potentially lead to the creation of network fees, warning these could distort the interconnection market, undermine net neutrality, and increase costs for businesses and consumers. Overall, BSA advocates targeted adjustments to ensure the DNA remains innovation-friendly and supportive of Europe’s digital competitiveness.
