BSA Leads Multi-Industry Statement on the EU Data Act
BRUSSELS – May 11, 2023 – Six leading EU-based organizations in the technology, security, and innovation sectors released a joint industry statement today, raising concerns about several provisions in the EU Data Act ahead of the next round of trilogue negotiations.
While the multi-industry group supports the EU Commission’s objective to develop and increase data sharing and reuse, they are concerned about implications resulting from mandatory data sharing, including the protection of IP and trade secrets, cloud switching, and interoperability requirements.
The cross-sector group – led by BSA | The Software Alliance and representing organizations based in Brussels, Berlin, and Paris – is urging EU policymakers to ensure that:
- Intellectual property and trade secrets are protected in the Data Act's B2B chapters.
- Cloud switching provisions provide diverse, secure, cost-efficient, and up-to-date solutions with practical requirements.
- Interoperability provisions align with the EU's international commitments, including obligations under the WTO Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs).
