Olga Medina, director of policy at the Business Software Alliance, said the private right of action crops up year after year in state privacy bills but so far hasn’t proven viable.
“We've seen it play out with the 20 laws that have been enacted so far, and they do not include a private right of action. Lawmakers, in an effort to ensure that their bill makes it over the finish line, are aware just how contentious a debate over privacy would become if they included it,” she said.
