Krach’s confirmation will strengthen the hand of European Privacy Shield proponents, said Aaron Cooper, vice president of global policy at industry association BSA. The industry association is an intervenor in the Quadrature de Net case and has filed a friend-of-the-court brief in the Schrems case, in both instances siding against the activists.
“The political will in both the US and the EU is invested in making the Privacy Shield work,” Cooper said. "Industry is invested in making it work. There’s a lot of momentum after two years.”
