We are disappointed in the outcome of today’s trial. The unauthorized copying for commercial purposes of substantial and essential elements of a competitor’s code in a manner that undermines the market for that software seems inconsistent with public interest goals of the fair use defense. We worry about the impact today’s verdict could have on the incentives for software companies to invest in research and development. Read more

BSA joins its voice to other industry stakeholders in support of a recent letter signed by ministers of fourteen European Union member states, which calls for a sound approach to reform in the implementation of the Digital Single Market strategy. The signatories advocate policies to foster robust competition and encourage investment and innovation. Policy proposals designed to deliver a digital single market should be evidence-based, future proof and address specific and well understood problems. Read more
