Advanced Manufacturing and Technology Industry Submission on Economic Espionage Concerns Relating to US Patent Policy

The emerging PTAB practice raises US national security and economic espionage concerns by increasing “security risks to American AI companies, talent, intellectual property, and systems,” thus weakening a core pillar of the Administration’s AI Action Plan. This PTAB practice also undermines the National Security Strategy because it strengthens the ability of foreign adversary-based companies, foreign non-practicing entities (NPEs), and foreign government-backed litigation financiers to attack US companies in court.
