Canada: BSA Letter on Law Enforcement Access Provisions in Canada Bill C-2

Business Software Alliance (BSA) recommends amending Bill C-2 to remove Part 15 entirely to avoid undermining strong encryption. BSA also urges amending Part 14 of the bill, including to create higher legal standards for law enforcement data access, direct legal requests to data owners when possible, and require post hoc warrants in exigent circumstances. BSA also calls for judicial oversight of non-disclosure orders, transparency through public reporting, and allowing technology providers to raise international comity challenges when facing legal conflicts across borders.
