EU: BSA Position Paper on the Digital Omnibus on AI (Simplification) Draft Proposal

BSA’s position paper on the Digital Omnibus on AI welcomes the European Commission’s simplification agenda and supports reforms that enhance regulatory clarity, proportionality, and innovation under the EU AI Act. The paper endorses measures such as more flexible post-market monitoring, voluntary codes of practice for general-purpose AI, and clearer legal bases for data processing, while recommending improvements to transitional periods, high-risk AI designations, and disclosure obligations. It also proposes additional simplification opportunities, including a more capability-based approach to regulating GPAI models, better alignment with the GDPR and cybersecurity frameworks, and a risk-based approach to retroactive compliance, with the overall aim of ensuring workable, future-proof AI regulation that strengthens Europe’s competitiveness
