EU: BSA Recommendations on the Second Draft of the EU Code of Practice on Transparency Requirements (Art. 50 of the EU AI Act)

BSA’s comments on the second draft of the EU Code of Practice on transparency requirements under Article 50 of the AI Act acknowledge improvements but raise remaining concerns about scope, proportionality, and technical feasibility. The submission calls for clearer exclusion of B2B and industrial use cases, stricter alignment with the AI Act, and more realistic obligations on marking and detection. It emphasizes that requirements should reflect technical limitations, avoid extending obligations to AI model providers, and remain risk-based, ensuring that the Code supports practical implementation without undermining innovation or legal certainty.
