India: BSA Submission on the Department of Telecom Review of PPP-MII Order

BSA recommends excluding software products and services from the scope of local content requirements under India’s Public Procurement (Preference to Make in India) Order, citing the global and interconnected nature of software development and deployment. BSA argues that such requirements hinder access to world-class technologies, discourage investment and job creation, and undermine digital transformation goals. If exclusion is not feasible, BSA urges the adoption of a points-based system to assess eligibility based on broader economic contributions like R&D, employment, and exports.
