US: BSA Amicus Brief in Tesla v. Granite Vehicle Ventures

BSA, together with other industry associations, filed an amicus brief in support of Tesla’s petition for certiorari, urging the Supreme Court to hold that the USPTO must follow Congress’s statutory framework for inter partes review, including the AIA’s one-year filing deadline, rather than impose extra-statutory timing rules or other discretionary barriers that restrict access to patent-validity review. BSA argues that Congress’s deadline controls whether a petition is timely and that the USPTO cannot treat statutory requirements for AIA review as optional or supplement them with additional conditions.
