US: BSA Special 301 Submission to USTR

BSA’s 2026 Special 301 submission focuses on the importance of US government efforts to promote IP and innovation policies that will advance US global leadership in AI. To this end, we urge USTR to promote greater legal certainty in the global environment for AI innovation by engaging with our trading partners to promote alignment with the US framework for IP protection relating to AI. This engagement should promote both the core substantive protections afforded by US patent and copyright law as well as flexibilities modeled on US law (both statutory and common law) that have been integral to US global leadership in AI and emerging digital technologies. This includes the flexibilities outlined in 17 USC 107 and elaborated in relevant US federal caselaw.
