BSA Continues Push for Changes as DOJ Finalizes Bulk Data Rules

The Justice Department should open a new public comment period on aspects of the final sensitive bulk data regulation, according to the Business Software Alliance, which offers support for controls on data brokers and other aspects of the AI-related rule but is still seeking significant changes even as the final version has now been published. 

“We do support the prohibition on data broker sales of sensitive personal data and government data to China,” Joseph Whitlock, BSA’s director of policy and executive director of the Global Data Alliance, told Inside AI Policy. But he cited concerns with recordkeeping and reporting provisions that his group has said “appear to create both outright conflicts and significant tension with a range of existing laws.” 

The simplest and most direct answer to these problems, Whitlock said, would be to move ahead with the prohibitions on “high risk” data transfers and reconsider other aspects of the rule -- which is not scheduled to take effect until April 8 -- including by seeking more public feedback.
