BSA Testifies Before USTR With Data Localization Concerns

BSA | The Software Alliance Director of Policy Joseph Whitlock illustrates the concerns that BSA has with USTR’s current policy that focuses on data localization mandates.
“I would say that we are concerned with what recommendations might come out of this inquiry” for several reasons, Joe Whitlock, policy director at BSA | The Software Alliance, said in an interview. Those include USTR’s move in October and its more recent decision to scale back references to foreign "data localization" mandates in its annual report on foreign trade barriers.
Whitlock told POLITICO he did not think USTR has the statutory authority to mandate or recommend a U.S. data localization requirement. He also noted the Justice Department has clarified that it does not intend to impose a data localization mandate as part of its proposed rulemaking to implement President Joe Biden's recent executive order to safeguard the personal data of Americans.
