BSA: APRA Invigorates Privacy Debate in US Congress

Service Provider Roles and AI Impact in Focus

WASHINGTON – BSA | The Software Alliance Senior Vice President of US Government Relations Craig Albright issued the following statement regarding the pending introduction of the American Privacy Rights Act:

“The introduction of the American Privacy Rights Act is a welcome development that invigorates and builds upon the work done in Congress to enact a strong and workable national privacy law. BSA commends Chair Maria Cantwell (D-WA) and Chair Cathy McMorris Rodgers (R-WA) for their bipartisan, bicameral work.

All consumers and businesses benefit from nationwide certainty about how their information is collected and processed. BSA | The Software Alliance has worked worldwide to advance privacy policies that ensure the use of personal data is consistent with consumers’ expectations. Privacy legislation is also foundational for enacting meaningful legislation addressing AI risks, another top priority on which BSA has worked for years.

Ensuring that the APRA is ultimately workable will require time to understand the underlying substance of the legislation, and how it would impact enterprise software companies. BSA will be focused on ensuring the bill reflects the role of service providers, who should be subject to strong obligations as they process data on behalf of other companies and subject to those companies' instructions. We have also urged lawmakers to create strong guardrails around how companies develop and deploy AI for high-risk uses and will be prioritizing the bill's effect on AI policy."
