BSA Calls for Clear and Practical Guidance on EU AI Transparency Rules

BRUSSELS — In its response to the European Commission’s targeted stakeholder consultation on transparency requirements under Article 50 of the AI Act, the Business Software Alliance (BSA) released the following statement:

“Transparency is essential for building trust in AI, but it has to be clear, practical, and flexible. Europe now has the opportunity to set guidance that works in the real world — by combining clear definitions, proportionate obligations, and room for innovation,” said Alice Stradi, Senior Manager - Policy EMEA.

BSA’s submission highlights the need to:

  • Clarify key definitions and scope, including concepts such as “synthetic text,” “emotion recognition systems,” and “biometric categorization systems,” and how obligations apply in different contexts.
  • Confirm that simple disclosure at the start of an AI interaction (e.g., chatbots, voice agents) meets the “first interaction” transparency requirement.
  • Allow flexible, channel-appropriate technical solutions for marking AI-generated content, avoiding rigid one-size-fits-all rules.
  • Recognize the current limitations of marking and detection technologies and promote interoperable, state-of-the-art standards, such as content provenance frameworks.
