BSA Supports House Bill to Reform ECPA Non-Disclosure Orders
WASHINGTON – April 6, 2022 – BSA | The Software Alliance issued the following statement regarding House Judiciary Committee Chairman Jerry Nadler’s bipartisan legislation – H.R. 7072, the NDO Fairness Act:
“We are encouraged by the House Judiciary Committee’s markup and approval of bipartisan legislation to reform the Electronic Communications Privacy Act’s (ECPA) provisions on non-disclosure orders (NDOs),” said Kate Goodloe, Senior Director, Policy at BSA | The Software Alliance. “This bill would raise the bar for issuing non-disclosure orders and create important limits to ensure those orders don’t last forever. These guardrails can help preserve consumer trust in cloud services and respect the privacy and due process of consumers. We are grateful for the leadership of Chairman Jerry Nadler (D-NY) and Rep. Scott Fitzgerald (R-WI) on this issue and support prompt consideration of H.R. 7072 before the full House.”
