Inclusion of Operating Systems in EU P2B Regulation Creates Legal Uncertainty and Security Risks

BRUSSELS – 6 DECEMBER 2018 – Today’s adoption of the EU Platforms to Business Regulation (P2B) report by the IMCO Committee of the European Parliament risks undermining the security and privacy of thousands business users of IT devices across Europe. By including Operating Systems (OS) in the Regulation’s scope, the European Parliament suggests that software developers should notify in advance (at least 15 days) their users for any changes in the system of their devices. This practically means revealing existing security vulnerabilities in public and eventually undermining user trust in the digital economy.

Thomas Boué, Director General – Policy, EMEA said: “It’s surprising that, without any impact assessment and real technical considerations, the European Parliament decided to include Operating Systems in the scope of this Regulation. Operating Systems and online intermediation services are very different. Instead of strengthening the Digital Single Market and enabling trust and innovation in the digital economy, the IMCO Committee today risks achieving the exact opposite, creating legal uncertainty and increasing security risks for all actors involved”.
