Australia: BSA Response to Proposed Security of Critical Infrastructure Act Amendments (Ministerial Direction Powers)

BSA filed comments on proposed amendments to the Ministerial Directions Powers in the Security of Critical Infrastructure (SOCI) Act. BSA’s response emphasized the importance of improving regulatory coherence and harmonisation before expanding Government intervention powers, noting the risks of added complexity and duplication in an already fragmented framework. BSA also provided recommendations across all proposed measures, highlighting the need for clearly defined thresholds, robust safeguards and review mechanisms, and proportionate, evidence-based use of powers that account for the operational realities of globally integrated cloud and software services.
