EU: BSA Submission to the EC Targeted Consultation on DSA’s Art. 18 (Criminal Offenses)

BSA’s submission to the European Commission’s consultation on Article 18 of the Digital Services Act calls for more transparent and more proportionate guidance for hosting service providers when notifying authorities of suspected criminal offences. It highlights the need for legal certainty regarding the scope of offences, key triggering concepts, and competent authorities, while noting practical and legal constraints, including fragmented national laws, limited contextual information, and data-sharing restrictions. The contribution stresses that clearer guidance is essential to ensure consistent application of Article 18 across the EU while avoiding over-reporting and safeguarding fundamental rights.
