BSA filed the following comments on the Korea Copyright Commission’s (KCC) Draft Fair Use Guidelines for Generative AI training, urging the KCC to allow more time and broader industry engagement, to ensure the Guidelines reflect the technical reality that AI training is non-expressive computational analysis permitted under existing exceptions, and to adopt a dedicated machine learning exception to provide legal certainty and support Korea’s AI innovation goals.
